Wills, Trusts & Probate

Roz Wyeth and her team offer a full range of Private Client work locally in Gosport and the surrounding areas.  Although this is a very technical area of the law, we pride ourselves on using ‘the King’s English’ and are passionate that clients understand exactly what they are signing and the implications of their wishes.  The last thing we want is for you to sign a document without really understanding what it means.

We are empathetic and sensitive when guiding clients through what can be extreme emotional trauma, for example when a loved one dies, and take time to listen and understand what is required.

Making a Will is one of the most important actions you can take to provide for those you leave behind and a professionally drafted Will ensures there is no ambiguity which can lead to misunderstanding and family fall outs after your death.

A subject that is very important to the vast majority of clients is the protection of assets from nursing home fees and we are specialists in drafting Wills to ensure, where possible, that your estate is not dramatically reduced should nursing home care be required in the future.

We also draft Lasting Powers of Attorney which are essential to ensure that someone you trust can look after your affairs should you become mentally incapacitated.  If a family member has lost capacity and has no Lasting Powers in place, we can also assist in making applications to the Court of Protection to appoint a Deputy to deal with that person’s affairs.

Very sadly, death comes to all of us eventually, and in those circumstances we can deal with the administration of estates in a timely and efficient manner.  If executors prefer to deal with the estate administration themselves, we also provide a ‘Grant only’ service whereby we submit inheritance tax returns and apply to the court for the Grant of Probate before handing the remainder of the administration over to the appointed executors.

Much of work is fixed fee and the costs are set out below:-

Administration of Estate work is charged on a time spent basis at an hourly charging rate of £260 per hour plus VAT.  We will be able to provide an estimate once we are made aware of the assets involved.

* There is a court fee of £82 per document payable directly to the Court in respect of the registration fee.

** Probate Court Fees are currently £273 plus £1.50 per copy Grant.
