Divorce

The breakdown of a marriage can be a very emotional and stressful experience.  Other factors may arise, such as disputes regarding the division of assets or the children.  At Wyeth & Paul Law, we are here to support you through this experience and to offer you guidance in a cost-effective manner by offering you out of court solutions to settle your case. 

 

To obtain a divorce in England and Wales, the husband and wife must have been married for one year and one party must have lived in England and Wales during the last year leading up to commencing the divorce proceedings.

No Fault Divorce

The introduction of the ‘no fault’ divorce which came about on 6th April 2022 sees a shift away from any party needing to blame the other for the breakdown of the marriage, with contested divorces becoming a thing of the past preventing unnecessary court hearings and, hopefully, reducing costs and time.

It is anticipated that by removing ‘fault’, parties will be able to focus on the really important issues upon separation, such as the arrangements for the children and the division of their financial assets, although all of these issues are dealt with separate to the actual divorce process itself.

These changes to the divorce law mean that couples can access a less complicated divorce process, potentially minimising legal expenses, and lengthy court proceedings. Separation Agreements

If you do not wish to start divorce proceedings immediately, perhaps you are unsure about divorce, but you need to divide capital or property assets, it is advisable to enter into a Separation Agreement. Whilst these Agreements are not legally binding, they will outline your intentions and can be highly persuasive if there is any later dispute over financial claims.
